Job Summary:

The Department of Human Services is looking for a motivated attorney to join its legal team and focus on significant federal policy issues. This position offers an opportunity to contribute to the vital work of DHS through a variety of responsibilities, including:

  • Serve as the DHS HIPAA Compliance and Privacy Officer.
  • Ensure compliance with all informed consent requirements across all divisions within DHS.
  • Represent the Department at county developmental disability board commitments and proceedings.
  • Maintain compliance with all federal regulations applicable to all divisions within DHS.
  • Brief DHS leadership and submit written comments on proposed federal regulations as needed.
  • Assist with Medicaid Waiver amendments, renewals, and compliance.
  • Review and maintain administrative rules in compliance with state and federal law changes.
  • Assist the Department in promulgating and amending administrative rules as necessary.
  • Review, revise, and maintain administrative policies for all divisions within DHS.
  • Provide legal research, briefing, and advice on emerging issues.
  • Represent the Department in administrative and circuit court legal proceedings .


Licenses and Certifications:

  • Must have a J.D. and be licensed to practice law in South Dakota.


The Ideal Candidate Will Have:


  • Experience in reviewing and applying federal regulations, preferably within the Human Services field.
  • Knowledge of HIPAA.
  • Knowledge of Medicaid and Medicaid waivers preferred, but not required.
