Summary/Objective?
This position is a mid-level position, responsible for collaboration between the Legal & Compliance department and the Merchant Support department. The Legal Path Recovery Specialist (“LPRS”) will assist the Vice President for Legal and Compliance (“VPLC”) and the Compliance Manager (“CM”) in managing recovery accounts that are in the litigation process, will be primarily responsible for identification of issues that require attention regarding the litigation process, will assist the Compliance Manager in the performance of his or her duties and will perform such related tasks as may be determined to be in the interest of the company from time to time.?
Essential Functions Regarding Merchant Support
The LPRS will manage the day-to-day collaboration between the Legal & Compliance department and the Merchant Support department.
The LPRS will be primarily responsible for identification of issues that require attention regarding the litigation process or pathways with law firms handling collections matters for the company.
The LPRS will access the Loan Management System to identify key aspects of each account under joint review by the Legal & Compliance department and the Merchant Support department.
The LPRS will track the accounts subject to a settlement agreement to ensure performance.
The LPRS will track accounts placed with law firms for collections litigation.
The LPRS provide such assistance regarding the litigation process or pathways as the VPLC or the CM may from time to time require.
The LPRS will establish a workflow schedule to ensure assigned tasks are completed or updated in a timely fashion.
Essential Functions Regarding the Compliance Function
The LPRS will assist the VPLC and the CM in developing and implementing a Quarterly compliance audit schedule.
The LPRS will assist the CM in managing the complaint response process.
The LPRS will assist the CM in managing the vendor management program.
The LPRS will assist the CM in developing compliance training materials and will assist in the training sessions.
The LPRS assists the Compliance Manager with developing, updating, and maintaining procedures and reference materials (“Content”) for all aspects of the business operations to ensure compliance with applicable laws and regulations.
The LPRS will review published Content periodically and monitor implementation of agreed upon revisions or changes in scope, format, content, and publication method.
The LPRS will assist the Compliance Manager in observing technical, operational, and frontline staff, end-users, and management to assess and document operational processes, system workflows and reference materials.
The LPRS will assist the VPLC and the CM in the development of a compliance risk management culture within the Company.
The LPRS provide such assistance regarding the compliance function as the VPLC or the CM may from time to time require.
General Responsibilities
The LPRS will generate reports as requested by the VPLC, the CM, and the Board of Managers.
The LPRS will report to CM any practices that are observed that may not comply with Company internal policies and procedures.
The LPRS will develop and maintain an effective working knowledge of laws and regulations affecting the company’s business and related guidelines.
The LPRS will complete such training as may be assigned by the VPLC or CM in a timely manner.
Supervisory Responsibility
This position does not have any supervisory responsibility.
Work Environment
This job operates in a professional office environment. This role routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets and fax machines.
Physical Demands
The physical demands described here are representative of those that must be met by an?employee to successfully perform the essential functions of this job.
This is largely a sedentary role; however, some filing is required. This would require the ability to lift files, open filing cabinets and bending or standing on a stool as necessary.
Position Type/Expected Hours of Work?
This is a full-time position, and hours of work and days are Monday through Friday, 8:00 a.m. to 5:00 p.m. Occasional evening and weekend work may be required as job duties demand.
Required Education and Experience
Be deadline-oriented and self-motivated.
Have a demonstrated ability to work both as part of a team and independently.
Have at least two years’ experience in commercial or civil litigation or other directly related experience.
Have demonstrated ability to effectively employ a variety of documentation tools, such as Microsoft Word, Excel, SharePoint, Visio, Adobe Acrobat, and/or other publishing software.
Have strong verbal and written communication skills, including spelling and grammar skills.
Be able to routinely meet in-person with both the management and the staff of all business units to effectively perform the duties and responsibilities listed above.
Have demonstrated project management skills, including the ability to manage multiple projects simultaneously.
Have demonstrated ability to understand, integrate, and explain rules, regulations, policies, and procedures to different audiences and deliver clear verbal and written presentations of facts or concepts.
Have demonstrated ability to exercise independent judgment while working under limited supervision; and
Have completed at least one of a bachelor’s degree, a paralegal degree, financial compliance certification or equivalent.
